What a Construction Contract in Mysuru Must Contain

Umashankara A

Most disputes between homeowners and builders do not start on site. They start on paper, or rather, on paper that was never written. A construction contract in Mysuru is often a two-page agreement with a rate, a vague description of the house and a signature. Everything the parties assumed but never wrote down becomes an argument later: which brand of cement, who pays for the borewell, what happens when rock appears in the trench.

This article is a checklist of the clauses that actually matter. It is general contract hygiene, not legal advice; for anything binding, have an advocate read the final document. But before a lawyer ever sees it, you as the client should be able to check that the contract answers seven practical questions. If it cannot, the problem is not legal drafting, it is missing substance.

We will use the practice at Uniq Builders, a Mysuru construction company working since 2009 with engineers, architects, surveyors and craftsmen on its own payroll, as the benchmark for what a written agreement should pin down.

Scope and the written specification

The single most important clause is the one that defines what is being built, and to what standard. A rate per square foot means nothing without a specification behind it. The contract should reference, by name and date, a written specification document that lists materials, brands or equivalent standards, and finishes for every stage: foundation, structure, masonry, plaster, flooring, doors and windows, electrical, plumbing, painting.

This is why Uniq Builders shares a written specification during the consultation itself, before any agreement is signed. Each of its packages, Premium at ₹1,999 per sq ft for premium standard construction, Gold at ₹2,499 per sq ft for modern semi-luxury standard construction with complimentary interiors, and Platinum at ₹2,999 per sq ft for luxury and tailored homes, fully customised with interiors included, is built to that written specification. All rates are starting rates, and terms and conditions apply. Whatever builder you choose, insist on the same discipline: the specification is an annexure to the contract, and construction is to that document, not to memory.

Check also that drawings are part of scope. A complete package should cover working drawings, 2D and 3D elevations, and structural design backed by a soil test, so the contract can point to a fixed set of drawings rather than sketches that keep changing.

Rate, area basis and the payment schedule

Three numbers-related clauses deserve close reading.

  • The rate and what it covers. Is the figure per square foot inclusive or exclusive of GST? Whatever the answer, the contract should say so plainly, along with any terms and conditions attached to the rate.
  • The area basis. Per square foot of what? Built-up area measurement conventions vary between builders, so the contract must define how area is measured, floor by floor, including balconies, headrooms and staircases. An ambiguous area basis can move the final bill more than the rate itself.
  • The payment schedule. Payments should be linked to completed stages of work, not to calendar dates. A stage-linked schedule means you pay for what exists on site: so much on foundation completion, so much on each slab, and so on through finishing. The final instalment should sit against handover, which keeps both sides motivated to finish.

Ask how the final figure is arrived at. A quotation over the phone is an estimate; a figure confirmed after the builder has stood on your plot is a commitment. Uniq Builders confirms the final figure only after a free site visit, and the packages page sets out what each rate covers before that visit happens.

Site conditions, approvals and who does what

Two areas generate more mid-project surprises than any other: the ground and the government.

On the ground, no builder can see below your plot before excavation. Rock excavation, additional foundation depth where the soil is weak, and imported filling earth for low-lying plots are genuine unknowns. A fair contract does not pretend they are included in the base rate; it names them explicitly and states that they are quoted separately, ideally after a site visit and soil test. That is exactly how Uniq Builders treats site conditions: rock, extra foundation depth and filling earth are assessed at the site visit and quoted separately, in writing, so they never appear as a shock in a running bill.

On approvals, the contract should assign responsibility clause by clause. Who obtains plan sanction? Who handles khata and licences, and the power, water and sewage connections? Who pays the statutory fees? In Uniq Builders’ packages the company handles plan sanction, khata and licences, and the utility connections, with free assistance for government licensing work, while statutory fees are paid directly by the client. Whatever split you agree, it must be written down, because an unassigned approval is a stalled site.

For a fuller picture of what a professionally run build includes at every stage, the residential construction service page describes the scope end to end.

Warranty, service and exit terms

The contract does not end at handover, and neither should its clauses.

  • Workmanship warranty. The agreement should state what is warranted after handover and for how long. Uniq Builders provides a workmanship warranty plus one year of free service after handover; use that as your baseline benchmark when comparing agreements.
  • Defect procedure. How do you report a defect, and within what time must the builder attend to it? A warranty without a response mechanism is decorative.
  • Exit and termination. What happens if either party wants out? The contract should cover termination notice, valuation of work completed, handover of drawings and approvals obtained so far, and settlement of payments. Nobody signs expecting to use this clause, which is precisely why it must exist while goodwill is still high.
  • Delay and variation. How are client-requested changes priced and recorded? Every variation should be a written, signed instruction with a cost, not a conversation with the site engineer.

Frequently asked questions

Is a per square foot rate alone enough to compare builders in Mysuru?

No. A rate is only meaningful against the specification it is tied to, the area measurement basis, whether GST is inclusive or exclusive, and how site conditions are priced. Two builders quoting the same rate can be hundreds of rupees apart once you read what each rate actually buys.

Who should handle plan sanction and khata in the contract?

Either party can, but the contract must name one. In Uniq Builders’ packages the company handles plan sanction, khata, licences and the power, water and sewage connections, while the client pays statutory fees directly. That split keeps paperwork with the professionals and government payments transparent to the owner.

What should the contract say about rock excavation and filling earth?

It should name these site conditions explicitly and state that they are quoted separately after a site visit, rather than hiding them inside the base rate or leaving them unmentioned. Uniq Builders assesses rock, additional foundation depth and imported filling earth during a free site visit and quotes them in writing. To have your own plot assessed, book a free site visit before you sign anything.
